Terms of Service

These Terms of Service (the “Terms”) form a binding agreement between you (“you”) and Dmytro Tkachuk, an individual sole developer trading as “Segurium” (“we”, “us”, “our”), governing your installation and use of the Segurium WordPress plugin (the “Plugin”) and the cloud service operated at cti.segurium.com (the “Service”, together the “Offering”).

By installing or activating the Plugin, by enabling cloud scanning in its settings, or by using the Service, you accept these Terms. If you do not agree, do not install, activate, or use the Offering.

Plain-language summary. The Plugin is GPL-licensed software. The Service is provided “as is” with no uptime guarantee. We log a randomly generated installation identifier and limited file metadata so the Service can return verdicts; what is sent is described in our Privacy Policy. We don’t take ownership of your data. Our liability is capped at fees you paid us in the prior 12 months. Spanish law applies.

1. The Offering

The Plugin is a WordPress plugin that scans your WordPress installation for malware and integrity drift, can clean infected files, and applies firewall and login-protection rules. The Service is the cloud component that returns verdicts for file hashes, supplies clean replacement files, distributes geolocation and threat data, and aggregates anonymous firewall events.

The Service relies on data the Plugin sends to cti.segurium.com. The categories and purposes of that data are described in the External Service Disclosure shown after activation and, in more detail, in the Privacy Policy. Both documents must remain consistent; if they diverge, the Privacy Policy controls in matters of data processing.

2. License to use the Plugin and Service

2.1 Plugin (GPL). The Plugin is distributed under the GNU General Public License, version 2 or later (GPLv2+). You may use, modify, and redistribute the Plugin under the terms of that license. Nothing in these Terms restricts the rights GPLv2+ grants you in the Plugin’s source code.

2.2 Service. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access the Service from one or more WordPress installations protected by the Plugin (each a “Site”) for the term you have paid for, or, for the free tier, for as long as the free tier is offered.

2.3 Pro features. Some Plugin features (the “Pro Features”) are gated by a paid license sold and delivered through Freemius (see §4). Pro Features unlock automatically when a valid license is associated with the Site.

2.4 Restrictions. You may not (a) use the Service in a way that exceeds the documented rate or volume limits; (b) attempt to reverse-engineer, scrape, or proxy the Service to provide it as a competing security product; (c) introduce malicious files, prompts, or payloads into the Service to interfere with its operation; (d) use the Service to scan or attack systems you do not own or do not have written permission to test; or (e) bypass licensing or entitlement checks.

3. Installation identifier and account lifecycle

3.1 IID. When you enable cloud scanning, the Plugin generates a random installation identifier (“IID”) and registers it with the Service. The IID is used to associate requests, verdicts, and entitlements with your Site. The IID is not derived from any personal identifier.

3.2 Multiple Sites. Each WordPress installation gets its own IID. A single paid license may cover one or more Sites depending on the bundle you purchased.

3.3 Lifecycle and deletion. You may delete the IID at any time by deactivating cloud scanning, uninstalling the Plugin, or asking us to delete it (see Privacy Policy — Your rights). On request we will delete the IID and the operational data tied to it within a reasonable period, subject to logs retained for security and accounting.

4. Fees, billing, and refunds

4.1 Free tier. The Plugin is free of charge, including the cloud-backed malware scanning, integrity verification, geo-blocking, and brute-force protection that ship in the free tier.

4.2 Pro tier. Pro Features are sold under annual subscriptions through our payment processor, Freemius, Inc. (“Freemius”). Freemius is the merchant of record for Pro purchases; its terms and tax handling apply to the transaction itself. Current pricing is shown on the pricing page.

4.3 Renewals. Annual licenses renew automatically unless cancelled before the renewal date. You can manage or cancel a license through the Freemius customer portal at any time.

4.4 Refunds. Pro Features carry a 14-day money-back guarantee from the date of first purchase. Refunds are processed by Freemius on our instruction. Renewals are not refundable beyond the 14-day window.

You agree that you will not, and will not permit any third party to:

6. Abuse, suspension, and takedown

If we have reasonable grounds to believe a Site is being used to violate §5, infringes a third party’s rights, hosts content that is unlawful in the European Union or in our jurisdiction, or threatens the stability or integrity of the Service, we may suspend access from that Site or its IID with notice where practicable, and without notice where the threat is immediate.

Rights-holders may report infringement and abuse to abuse@segurium.com. We will action good-faith reports within a reasonable time.

7. Term and termination

7.1 By you. You may stop using the Offering at any time by deactivating cloud scanning, uninstalling the Plugin, and (for Pro) cancelling your license through Freemius.

7.2 By us. We may terminate these Terms or your access to the Service for material breach of these Terms (including §5), for non-payment, or if we discontinue the Offering. Where the breach is curable we will give you a reasonable opportunity to cure it.

7.3 Effect of termination. On termination your license under §2.2 ends. Sections that by their nature should survive termination — including §11 (Disclaimer), §12 (Limitation of liability), §13 (Indemnification), §17 (Governing law) and §18 (Miscellaneous) — will survive.

8. Privacy and data protection

Our processing of personal data is described in the Privacy Policy, which forms part of these Terms by reference. For the categories of data the Plugin sends to the Service we are the data controller; for the content of files you process on your Site we are not the controller of your visitors’ data — you remain the controller of personal data on your WordPress installation.

9. Intellectual property

Except for the Plugin, which is licensed under GPLv2+, all rights in the Offering — including the Service’s code, infrastructure, threat-intelligence data, brand, and the “Segurium” name and logo — are owned by us or our licensors. Nothing in these Terms transfers ownership of those rights to you. You may not remove or alter our notices or use our brand to imply endorsement.

You retain all rights in your Site and the files you submit. You grant us a limited, non-exclusive, royalty-free licence to process those files and the metadata you send to the Service, only as needed to provide the Offering and as described in the Privacy Policy.

10. Feedback

If you send us suggestions or feedback, we may use them without obligation to you and without compensation. We will not identify you in connection with the feedback unless you ask us to.

11. Disclaimer of warranties

To the maximum extent permitted by applicable law, the Offering is provided “AS IS” and “AS AVAILABLE”, without warranty of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, non-infringement, or that the Offering will be uninterrupted, error-free, or will detect or remove every threat. Security tools reduce risk; they do not eliminate it. You remain responsible for backups, for restoring service after an incident, and for verifying scan and cleanup results.

Nothing in these Terms excludes or limits any warranty or liability that, under applicable law, cannot be excluded or limited — in particular consumer rights of natural persons resident in the EU.

12. Limitation of liability

To the maximum extent permitted by applicable law, our aggregate liability for any and all claims arising out of or relating to the Offering — whether in contract, tort, statute, or otherwise — is limited to the total fees you paid us (directly or via Freemius) for the Offering in the twelve (12) months immediately preceding the event giving rise to the claim. For users of the free tier, that amount is €0; nothing in these Terms requires us to refund free use.

We are not liable for indirect, special, consequential, incidental, exemplary or punitive damages, or for loss of profits, revenue, goodwill, or data, even if we have been advised of the possibility of such damages.

This Section does not exclude liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be excluded.

13. Indemnification

You will defend, indemnify and hold us harmless from any third-party claim, demand, or liability arising out of (a) your breach of these Terms, including §5; (b) your use of the Offering on Sites or against systems you are not authorised to administer; or (c) content or data you submit to the Service that infringes a third party’s rights.

14. Third-party services

The Offering integrates with third parties — in particular Freemius for billing and license delivery, our SMTP provider for transactional email, and the WordPress.org plugin directory for distribution. Use of those services is also subject to their own terms. We are not responsible for changes those providers make to their services.

15. Force majeure

We are not liable for failure or delay in performance caused by events beyond our reasonable control, including failures of upstream connectivity or hosting, large-scale internet incidents, government action, war, civil unrest, or natural disaster.

16. Changes to the Offering and these Terms

The Offering will evolve. We may add, change, or remove features at any time. For material changes that reduce functionality you have already paid for, we will give reasonable notice and, where appropriate, a pro-rata refund.

We may revise these Terms. The current version is always at segurium.com/terms with a “Last revised” date. For material changes we will notify you in the Plugin’s admin UI or by email to the contact address registered for your license, at least 30 days before the change takes effect, except where a shorter period is needed to comply with law or to address a security risk. Continued use of the Offering after the effective date is acceptance of the revised Terms; if you do not agree, stop using the Offering.

17. Governing law and venue

These Terms are governed by the laws of Spain, without regard to its conflict-of-laws rules. The courts of Spain have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Offering. If you are a consumer resident in another EU member state, this clause does not deprive you of the protection of mandatory consumer-protection rules of your country of residence, and you may also bring proceedings in the courts of that country.

18. Miscellaneous

Entire agreement. These Terms, together with the Privacy Policy and any pricing or order page you accepted, are the entire agreement between you and us regarding the Offering, superseding any prior agreement.

Severability. If any provision is held unenforceable, the rest will remain in effect, and the unenforceable provision will be reformed only to the minimum extent necessary.

No waiver. Our failure to enforce a provision is not a waiver of the right to enforce it later.

Assignment. You may not assign these Terms without our prior written consent. We may assign them to a successor in connection with a transfer of the Offering, on notice to you.

Notices. Notices to you may be given through the Plugin’s admin UI, the registered contact email for your license, or a posting on segurium.com. Notices to us must be sent to the address in §19.

Independent parties. Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship.
